1. General Terms.
In consideration of hosting services to be delivered, Customer agrees to be bound by the following terms and conditions:
1.1. Customer agrees to pay, in advance of each monthly or yearly service term (Customer's discretion), for hosting services to be rendered.
1.2. Customer agrees to be bound by the service term selected on the online order form or via applicable promotional codes that may require Customer to order Solid Hosting's service for a certain minimum period of time.
1.3. Customer agrees to a no-refund policy in advance. Setup fees and monthly web hosting service fees are non-refundable.
1.4. Non-Payment of services shall result in a 7-day notice of disconnection. All payment failures must be cured within 7 days of notice.
1.5. Solid Hosting is not and shall not be responsible for data integrity for any accounts that are terminated, disconnected, or interrupted because of Customer’s failure to pay for Solid Hosting's services.
1.6. Customers agrees to pay all tax applicable to your account (tax is included in all costs quoted on Solid Hosting website).
2.1. Establishment and provision of service is contingent upon receipt of payment from Customer to Solid Hosting.
2.1.1. Customer must pay in full for the Services before Solid Hosting begins to provide the Services to Customer.
2.1.2. Setup fees will be charged and are due at the time of the Customer’s initial request of the Services requiring setup, unless specified that no set up fees are due.
2.2. Payment is due on the defined monthly or recurring billing date of each month.
2.2.1 Hosting Renewal charges will occurr at the due date automatically. If automatic credit card charging on the due date fails, Service will be interrupted on accounts that reach 7 days past due.
3. Delinquent Accounts.
3.2 Failure to make payment on or before the renewal date will result to account suspension or termination. Account is suspended 5 days after the renewal date while termination will occur 7 days after the renewal date.
3.1 Solid Hosting may temporarily deny service or terminate this Agreement upon failure of Customer to pay charges when due. Such termination or denial will not relieve Customer of responsibility for the payment of all accrued service fees, and any collection fees to which Solid Hosting may be entitled under this Agreement or under applicable law.
3.3 Solid Hosting is not and shall not responsible for data integrity for any accounts that are suspended, interrupted, disconnected or terminated for non-payment of Services.
4. Account Cancellation.
4.1 Customers may voluntarily cancel their account at any time, for any reson or for no reason, subject to the following:
Shared and Reseller Hosting Plans (Linux and Windows). Customer may cancel anytime by sending an email to sales[at]Solid Hosting.
Virtual Private Servers (VPS) and Dedicated Servers. Customer must notify Solid Hosting 30 days prior to due date by sending an email to sales[at]solidhosting.ph.
Colocation. Customer must notify Solid Hosting 30 days prior to due date by sending an email to sales[at]solidhosting.ph.
4.2 Customer understands and agrees that Solid Hosting will not provide any refunds in connection to account cancellations and server abuse.
5. Refunds and 45-Day Guarantee.
5.1 Except as explicitly provided in this section, all payments to Solid Hosting, including, but not limited to, setup fees and annual fees regardless of usage, are non-refundable.
5.2 Without waiving any of its other rights under the Agreements, Solid Hosting offers to its Customers a one-time 45-day money-back guarantee ("45-Day Guarantee") ONLY on fees for hosting services, but NOT including any of the following fees:
5.2.1 Setup fees;
5.2.2 Fees for domain name registrations and renewals;
5.2.3 Fees charged for exceeding your allotted disk space or bandwidth;
5.2.4 SSL certificate fees;
5.2.5 Any add-on services, features, software; and
5.2.6 Any other fees for services involving a third party. You may not transfer or assign the 45-Day Guarantee to any third party.
5.2.7 Dedicated Server, VPS and Colocation.
5.3 Customer is entitled to a maximum of one (1) 45-Day Guarantee. The 45-Day Guarantee applies only to your first order of Web hosting services from Solid Hosting. Changes to your service, including, but not limited to, adding new services, removing services, or changing the type of hosting plan do NOT make you eligible for an additional 45-Day Guarantee. If you have ever previously obtained a refund under the 45-Day Guarantee, whether or not in relation to your existing account, your existing account will be canceled, but no money will be refunded to you.
5.4 The 45-Day Guarantee may be availed by the cancellation of account within forty five(45) days from the start of the Term, by sending a cancellation request email to sales[at]solidhosting.ph, as provided in Clause 4 above. If you do not cancel your account within forty five(45) days of the beginning of your service, your right to the 45-Day Guarantee shall expire forever and may not be revived under any circumstances, without our written approval.
5.5 You will not be eligible for the 45-Day Guarantee if you violate any of the provisions of the Agreements. You agree that you will not circumvent the restrictions on the 45-Day Guarantee described in this document, or attempt to circumvent those restrictions by any means, including, but not limited to, the following actions:
5.5.1 Creating multiple accounts, using the same account name or different account names;
5.5.2 Canceling your account for the sole purpose of obtaining a refund and then registering for a new account;
5.5.3 Organizing multiple business entities or using assumed business names for the purpose of circumventing these restrictions;
5.5.4 Knowingly providing false or inaccurate information when you register for your account; or
5.5.5 Requesting a refund under the 45-Day Guarantee at any time after you have already received a refund under that guarantee.
6. Abuse of Solid Hosting Personnel
6.1 Solid Hosting takes pride in providing excellent service to all its Customers. It is our policy to treat our Customers with the highest level of respect and courtesy, and, in return, we expect the same respect and courtesy from you. If our staff feels that you are consistently engaging in abusive content toward them, or addressing them in a demeaning or rude manner, your account(s) may be suspended and you may be asked to take your business elsewhere. In the event that we terminate the Service for abusive conduct, customers will be given five (5) days’ notice to find a new service provider. We will issue a refund only for the unused portion of pre-paid service.
6.2 Abusive conduct includes, but is not limited to, the following behaviors: (a) Repeatedly addressing members of our staff in a demeaning or rude manner; (b) Using profanity in any oral or written communications with our staff, by any medium of communication, including but not limited to e-mail, instant messages, chat, text messaging, fax, postal mail, telephone, voice over Internet Protocol (VoIP), or in-person communication; (c) Yelling or shouting at our staff; (d) Deliberately using all capital (uppercase) letters in any written communication to our staff; (e) Insulting our staff because of their personal characteristics, or on the basis of their race, ethnicity, national origin, sex, sexual orientation, religion, or housing or economic status; or (f) Deliberately providing false information to our staff for the purpose of harassing them or wasting their time.
7. Violation of Laws
7.1 Customer agrees not to engage in any activity that violates any international, foreign, federal, state, or local laws applicable to the service terms described in this Agreement.
7.2 Solid Hosting reserves the right to discontinue service to any Customer it deems, in its sole discretion, violates any condition of service including, but not limited to, the following:
7.2.1 Acceptable Use Policy
8.1 Customers are responsible for maintaining their own set of account backup. Solid Hosting will only retain client backup 30 days from its termination date. If a client renews their account after 30 days, he/she is responsible in reuploading the loss data/content.
8.2 Solid Hosting accounts are backed up daily and weekly. However, these backups are intended for Solid Hosting's administrative purposes only, to allow us to provide excellent service to our customers.As part of its commitment to first-rate customer service, Solid Hosting always seeks to create complete and accurate backups of customer accounts.
8.3 Solid Hosting does not guarantee the completeness, availability, currency and integrity of its backups. Customer understand and agree that Solid Hosting's backup policy does not create, and Solid Hosting disclaims, any warranties, expressed or implied, for which Solid Hosting can be held liable.
8.4 Solid Hosting does not provide compensation of any kind for lost, inaccurate, incomplete, or outdated data in the event that Solid Hosting backups do not function properly, regardless of the reason(s) for any such malfunction, even if the malfunction was due to the fault or negligence of Solid Hosting or any of its employees or agents, and regardless of whether Solid Hosting had been informed of the possibility of such malfunction, or any fault or negligence that might cause it.
8.5 Solid Hosting does not provide backup for Virtual Private Servers, Dedicated Server and Colocated Server otherwise an agreement has been placed.
8.6 In the event that you need to recover data from a backup, Solid Hosting will use reasonable efforts to restore data to your account from the appropriate backup. However, please note this service is intended to complement your own backups to your own computer, and is not a substitute for those backups. Again, Solid Hosting does not guarantee the availability, completeness, currency, or integrity of its backups.
8.7 You understand and agree that Solid Hosting's backup policy does not create any warranties for whose breach Solid Hosting can be held liable.
